Terms of Service
Please read these terms carefully before using our fenix padel booking platform and services.
1. Introduction
Welcome to Fenix Padel ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our website, mobile applications, and services including but not limited to court bookings, coaching sessions, membership plans, and related facilities located in Indonesia.
By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services. These Terms constitute a legally binding agreement between you and Fenix Padel.
2. Definitions
"User" or "Customer"
Any individual who registers for an account or uses our services, including walk-in customers and members.
"Coach"
A certified padel instructor employed or contracted by Fenix Padel to provide training sessions.
"Booking"
A reservation made through our platform for coaching sessions, court rentals, or class participation.
"Membership Plan"
A prepaid package that provides users with a set number of sessions or credits at discounted rates.
"Session"
A scheduled time slot for coaching, training, or court usage, typically lasting between 60 to 120 minutes.
3. Account Registration
To access certain features of our services, you must create an account. When registering, you agree to:
- Provide accurate, current, and complete information including your full name, email address, and phone number
- Maintain and promptly update your account information to keep it accurate
- Keep your password secure and confidential, and not share your account credentials with others
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
You must be at least 18 years old to create an account. Users under 18 may use our services only with the involvement and consent of a parent or legal guardian. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Booking & Scheduling
4.1 Making Bookings
Bookings can be made through our website or mobile application. All bookings are subject to availability and confirmation. A booking is only confirmed once payment has been successfully processed and you receive a confirmation notification.
4.2 Walk-in Bookings
Walk-in bookings are available subject to court and coach availability. Walk-in customers must complete registration and payment before their session begins.
4.3 Additional Players
You may add additional players to your booking session. Each additional player may incur extra charges based on the coach level and session type. All additional players must comply with our facility rules and code of conduct.
4.4 Rescheduling
Bookings may be rescheduled subject to the following conditions:
- Rescheduling requests must be made at least 24 hours before the scheduled session
- Rescheduled sessions are subject to coach and court availability
- A maximum of one reschedule per booking is permitted
- Late rescheduling requests (less than 24 hours) may be subject to fees or may not be permitted
4.5 Punctuality
Please arrive at least 10 minutes before your scheduled session. Sessions will start and end at the scheduled times regardless of late arrival. No extensions will be provided for late arrivals, and no refunds will be given for time lost due to late arrival.
5. Payment Terms
5.1 Accepted Payment Methods
We accept various payment methods through our payment processor, including:
- Bank Transfer (Virtual Account)
- QR Code Payments (QRIS)
- E-Wallets (OVO, GoPay, DANA, ShopeePay, LinkAja)
- Credit/Debit Cards
- Cash payments (for walk-in bookings at our facility)
5.2 Pricing
All prices are displayed in Indonesian Rupiah (IDR) and include applicable taxes unless otherwise stated. Prices may vary based on coach level, session duration, time slot (peak/off-peak), and number of players. We reserve the right to modify prices at any time, but changes will not affect confirmed bookings.
5.3 Payment Processing
Payment must be completed to confirm your booking. Virtual Account and QR code payments must be completed within the specified time limit (typically 24 hours). Expired payment requests will result in automatic cancellation of the booking. Payment processing fees may apply depending on the selected payment method.
5.4 Failed Payments
If a payment fails, your booking will not be confirmed. You may attempt payment again or choose a different payment method. Repeated failed payment attempts may result in temporary restrictions on your account.
6. Cancellation & Refund Policy
6.1 Customer-Initiated Cancellations
- More than 48 hours before session:100% refund
- 24-48 hours before session:50% refund
- Less than 24 hours before session:No refund
- No-show:No refund
6.2 Academy-Initiated Cancellations
In the event that we must cancel a session due to coach unavailability, facility maintenance, or unforeseen circumstances, you will be offered:
- A full refund to your original payment method, OR
- Rescheduling to an alternative date/time at no extra cost
6.3 Weather & Force Majeure
For outdoor sessions affected by severe weather conditions or force majeure events (natural disasters, government restrictions, etc.), we will work with you to reschedule or provide a full refund.
6.4 Refund Processing
Approved refunds will be processed within 7-14 business days to your original payment method. Bank transfer refunds may take additional time depending on your bank's processing times.
7. Membership Plans
7.1 Membership Benefits
Membership plans offer discounted rates and priority booking access. Benefits vary by membership tier and may include: discounted session rates, priority booking windows, exclusive access to certain coaches, and special event invitations.
7.2 Membership Validity
Membership plans have a specified validity period from the date of purchase. Unused sessions or credits will expire at the end of the validity period and are non-refundable. Extensions may be granted at our discretion in exceptional circumstances.
7.3 Non-Transferability
Membership plans are personal and non-transferable. They may only be used by the registered member and cannot be shared, sold, or transferred to another person.
7.4 Membership Cancellation
Membership purchases are final and non-refundable except where required by law. If you wish to cancel your membership, please contact our customer service for assistance.
8. Code of Conduct
All users must adhere to the following code of conduct while using our facilities and services:
8.1 Facility Rules
- Appropriate sports attire and non-marking court shoes must be worn at all times
- Food and beverages (except water) are not permitted on the courts
- Smoking, vaping, and alcohol consumption are prohibited in all facility areas
- Users must respect the allocated time slots and vacate courts promptly at the end of sessions
- All equipment must be handled with care and returned in good condition
8.2 Behavioral Standards
- Treat all staff, coaches, and fellow users with respect and courtesy
- Abusive, threatening, or discriminatory behavior will not be tolerated
- Maintain good sportsmanship during all sessions and activities
- Follow all instructions given by coaches and facility staff
- Report any safety concerns or facility issues to staff immediately
8.3 Consequences of Violations
Violations of this code of conduct may result in warnings, session termination without refund, temporary suspension, or permanent ban from our facilities at our sole discretion.
9. Liability & Disclaimers
9.1 Assumption of Risk
Padel is a physical sport that carries inherent risks of injury. By participating in sessions at our facility, you acknowledge and accept these risks. We recommend consulting with a healthcare professional before engaging in physical activities if you have any health concerns.
9.2 Personal Property
We are not responsible for any loss, theft, or damage to personal property brought to our facilities. Lockers are provided for your convenience but usage is at your own risk. Valuables should not be left unattended.
9.3 Limitation of Liability
To the maximum extent permitted by Indonesian law, Padel Academy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount paid for the specific service giving rise to the claim.
9.4 Service Availability
We strive to maintain continuous service availability but do not guarantee uninterrupted access to our booking platform. Scheduled maintenance and unforeseen technical issues may affect service availability.
10. Privacy & Data Protection
Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.
By using our services, you consent to the collection and processing of your personal data as described in our Privacy Policy, including but not limited to: account information, booking history, payment details (processed securely through our payment partners), and usage data.
We comply with applicable Indonesian data protection regulations, including Government Regulation No. 71 of 2019 concerning the Implementation of Electronic Systems and Transactions.
11. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated through:
- Email notification to registered users
- Prominent notice on our website
- In-app notifications
Changes become effective upon posting unless otherwise specified. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms. If you do not agree to the changes, you should discontinue use of our services.
